Terms of Service

Volty is a brand of HJ Atlas Pty Ltd (ABN 46 701 729 777), based in Sydney, NSW, Australia. These terms govern your use of Volty — the driver mobile app, the strata console at app.volty.com.au, and this website. By creating an account or using the service you agree to them. If you're using the console on behalf of an owners corporation or strata manager, you confirm you're authorised to bind that organisation.

1. What Volty is

Volty meters EV charging in apartment buildings using the vehicle's own reported data (via Enode) and bills each driver per session at the rate set by their building. Charging revenue settles to the building's owners corporation — the merchant of record for every payment — through our payment partner, Pinch Payments. Volty facilitates metering and billing; we do not supply electricity, and we are not a party to the arrangement between a resident and their owners corporation about using common-property power.

2. Accounts

• You must provide accurate information and keep your sign-in credentials secure. You're responsible for activity on your account.
• Drivers join a building using an invite code issued by its organisation. Joining gives that organisation visibility of your charging at their sites.
• You must be at least 18 to hold an account.

3. Charging sessions and billing

• A session starts when your linked vehicle reports it is plugged in and charging inside one of your building's charging areas, and ends when you unplug or charging stops.
• Energy is metered from your vehicle's own reporting. Sessions are billed at your building's per-kWh rate as at the start of the session, shown in the app.
• Your saved card is charged automatically when a session ends. Receipts (tax invoices where the owners corporation is GST registered) are available in the app and console.
• By saving a card you authorise Volty, through Pinch, to charge it for your completed sessions. Failed payments can be retried in the app; sessions remain payable until settled.
• Volty's platform fee is deducted from amounts settled to the owners corporation. Pinch's payment terms also apply to payment processing.

4. Vehicle connection

Linking your EV uses Enode and your vehicle manufacturer's account, under their respective terms. Vehicle-reported data (including charge state and location while checking you're on site) is used as described in our Privacy Policy. Metering accuracy depends on your vehicle reporting correctly; if a vehicle reports incorrect data, we may reasonably adjust or re-bill a session to reflect actual energy delivered.

5. Organisations

• Organisations are responsible for the rates they set, the accuracy of their merchant and settlement details, and for having the necessary authority to bill residents for common-property electricity.
• Settlement of charging revenue is made by Pinch to the bank account the organisation nominates.

6. Acceptable use

Don't misuse the service — including attempting to bypass metering or geofencing, interfering with other users' sessions, probing or disrupting our systems, or using the service for any unlawful purpose. We may suspend or close accounts that do.

7. Availability and changes

We aim to keep Volty available and accurate, but the service depends on third parties (vehicle APIs, Enode, Pinch, cloud infrastructure) and is provided on an "as available" basis. We may change, suspend or discontinue features with reasonable notice where practicable.

8. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law: Volty is not liable for indirect or consequential loss; our total liability in connection with the service is limited to the amounts you paid through Volty in the three months before the claim; and we are not responsible for the supply, quality or safety of electrical infrastructure at your building.

9. Termination

You can stop using Volty and close your account at any time — amounts owing for completed sessions remain payable. We may suspend or terminate accounts for breach of these terms, with notice where reasonable.

10. General

These terms are governed by the laws of New South Wales, Australia. If any part is unenforceable, the rest still applies. We may update these terms; material changes will be notified in the app or by email, and continued use after that is acceptance.
